Law No. 7/2004 of May 5
Organic Law of the Falintil – East Timor Defense Forces (Falintil-ETDF)
The East-Timor Defense Forces, also known by the acronym Falintil-ETDF, are the legitimate successors to the glorious Armed Forces for the National Liberation of East Timor – FALINTIL.
The FALINTIL, Armed Forces for the Liberation of East Timor are the repository and witness of the courage of our People who cherish Peace, Liberty and Human Dignity, values which we proudly adopted as ours, ever since our memory as a Nation can attest. They are ancestral values that were set forth as basic rights in the language of the Constitution of the Democratic Republic of East Timor.
The Constitution defines the intrinsic nature and broad parameters that established the creation of the Armed Forces of East Timor, in the set of values that guided the action of the FALINTIL- Armed Forces for the Liberation of East Timor, even during the most difficult moments of the military conflict and occupation, and during the international isolation which, for some time, we were subjected to.
Once the independence of the Falintil-ETDF was restored, the responsibilities were increased and broadened in terms of communicating and working with the other defense and security institutions and other State institutions to guarantee and safeguard the sovereignty of the country, to defend the Constitution, defend the law and the democratically elected institutions. And, just as before, currently the Falintil-ETDF must continue to respect the People they serve and be an example of courage and a reason for pride.
Thus, it is important to describe in greater detail the mission of the Falintil-ETDF, its command structure and institutional communication mechanisms, in order to honor the memory of all who gave their lives to create the Democratic Republic of East Timor.
Therefore, by Government decree, under the terms of Article 116, paragraph d) of the Constitution, the following will become law:

CHAPTER IGeneral Principles
Article 1Nature of the ETDF
1. The Falintil-ETDF are the Armed Forces of the Democratic Republic of East Timor, whose mission is to provide the military component of national defense.
2. The Falintil - ETDF are strictly non partisan and are a single organization for the whole country.
Article 2Allegiance to the Flag
1. All duly qualified young adults who join the ranks of the Falintil - ETDF shall pledge allegiance to the flag, according to the previously approved formula stated above.
2. The pledge of allegiance is a commitment to serve and act according to that pledge, subject to military discipline, civil or criminal law.
Article 3Mission of the Armed Forces
1. The general mission of the Falintil - ETDF is to:
a) Take up military defense of the Democratic Republic of East Timor against any foreign aggression or threat;
b) Guarantee national independence, territorial integrity, freedom and security of the population, against any kind of foreign threat or aggression.
2. The Falintil – ETDF, aside from their general mission referred to in the previous paragraph, shall also by law:
a) Support the NPET, in case of serious or widespread disruption to public order which would not justify immediately declaring a state of siege or state of emergency, in order to avoid the suspension of basic rights;
b) Provide assistance, at government request, to the civilian population and cooperate with the executive authorities in missions to protect and assist the population in cases of catastrophe and natural or man-made disasters, which do not justify immediately declaring a state of emergency, in order to avoid the suspension of basic rights.
3. The conditions for the use of the Armed Forces when a state of siege or a state of emergency is confirmed shall be set according to national regulations governing the state of siege or state of emergency.
4. The Falintil – ETDF, may also be involved, according to the law, in military technical cooperation, within the scope of our national cooperation policies and in accordance with our country’s international commitments.
Article 4 Exclusivity Principle
1. The military component to our national defense shall be exclusively provided by the Falintil - ETDF, except in the case of an invasion by foreign forces, whereupon each Timorese citizen has the duty to engage in preemptive or passive resistance in the areas of the national territory invaded or occupied by foreign forces.
2. All armed military-type, militarized or paramilitary groups are outlawed.
3. Any violations to the above provision will constitute willful disregard under criminal law, or even a more serious crime.
Article 5 ETDF Uniforms
1. All members of the Falintil - ETDF in service must wear mandatory uniform according to the terms of upcoming regulations.
2. No other person may wear a military uniform, whether the Falintil - ETDF uniform, or similar uniform, for such action will constitute willful disregard, as stipulated by law.
Article 6Weapons and Military Equipment
1. The Falintil - ETDF are authorized to purchase, keep and use weapons and equipment for military purposes under the law.
2. The members of the Armed Forces have the right to use weapons and military equipment in accordance to internal regulations for its use and control.
Article 7Integration of the Falintil – ETDF as part of the Executive Branch of Government
1. The Falintil - ETDF are integrated into the Executive Branch of Government through the Minister of State for Defense, and under the terms of the Constitution and the law they are subordinate to the competent sovereign authorities.
2. The Head of National Defense is politically responsible for developing and implementing the military component of national defense, the management of the Armed Forces, the readiness of military resources and the results of their use.
CHAPTER IITHE FALINTIL-ETDF STRUCTURE
Article 8Chain of Command
The Chain of Command within the Government directly responsible for the Falintil - ETDF is as follows:
a) The President;
b) The National Parliament;
c) The Government; and,
d) The Joint Chief of Staff of the Falintil - ETDF.
Article 9The Commander in Chief of the Armed Forces
The President, under his powers, is inherently the Commander in Chief of the Armed Forces and in that capacity has the following rights and duties:
a) A duty to contribute, under the scope of its constitutional powers, to ensure loyalty of the Armed Forces to the Constitution and to the democratic institutions, and to make public that loyalty in the name of the Armed Forces;
b) The right to be informed by the Government about the status of the Armed Forces and their components;
c) The right to privately advice the Government about the application of national defense policies;
d) The right to consult with the Joint Chief of Staff of the Armed Forces and the Chiefs of Staff of the different services.
e) In case of war, the right to assume its leadership together with the Government and the duty to contribute to the morale and combat readiness of the Armed Forces.
f) The right to award, on his own initiative, military decorations; and,
g) The right to hold the highest position in the Armed Forces hierarchy.
Article 10The National Parliament
The National Parliament, as a sovereign body of the Democratic Republic of East Timor, and as representative of all Timorese citizens, has the right to oversee Government action concerning the Armed Forces.
Article 11The Government
1. The Government is the executive arm for national defense policy and the highest administrative office for the Armed Forces
2. The Prime Minister is politically responsible for the implementation of national defense, and his duties include:
a) Coordinating and guiding government action in issues related to the Armed Forces;
b) Leading inter-ministerial activities for the implementation of national defense policy;
c) Participating in the State Council and the High Council for Defense and Security.
d) Keeping the President informed on issues related to the Armed Forces and to the implementation of national defense policies.
3. When there is a declaration of war, the Prime Minister plays his role as Head of Government, with the President as his inmediate superior.
Article 12Ministry of State for Defense
The Ministry of State for Defense is the government structure in charge of designing, implementing, coordinating and assessing the policy defined and approved by the Council of Ministers for the purpose of national defense. Namely, administration and oversight of the Falintil - ETDF, as well as training and preparing military resources and military cooperation under the terms of the Constitution and the laws.
Article 13EDTF Military Command
1. The military authority in command of the Falintil - ETDF is the Chief of the Joint Chiefs of Staff of the Armed Forces assisted by the Deputy Joint Chief of Staff.
2. The general guidelines for the organization of the Falintil - ETDF shall be approved and regulated by Government decree.
Article 14ETDF Composition
1. The Falintil - ETDF are exclusively made up of citizen volunteers, eligible for military service under the nationality law and other applicable legislation.
2. No person under 18 years of age may be recruited for military service in the Falintil - ETDF.
3. The Falintil - ETDF are made up of regular forces that perform as combat and support units.
4. The Combat units are organized as a land component with infantry battalions, and a naval component with marine units..
5. Other specialized units may be created when deemed necessary.
Article 15Joint Chief of Staff of the Falintil – ETDF
1. The Joint Chief of Staff of the Armed Forces is the military chief with the highest authority in the Falintil - ETDF hierarchy and the military advisor to the Minister of State for Defense.
2. The Joint Chief of Staff of the Armed Forces is appointed and removed by the President, upon recommendation by the Government.
3. The Joint Chief of Staff is responsible, within the scope of his powers, for the execution of Government decisions in matters concerning national defense and the Armed Forces..
4. The Joint Chief of Staff is at all times responsible to the Government, through the Minister of State for Defense, for the readiness, discipline and use of the forces and resources that make up the operational component.
5. In times of peace, the Joint Chief of Staff of the Falintil - ETDF has the operational command of the forces, and to that effect, the Falintil - ETDF unit commanders are his subordinates.
6. In a state of war, the Joint Chief of Staff of the Falintil - ETDF has joint authority, together with the President and the Government, through the Prime Minister, over the total command of the Falintil - ETDF.
7. The Joint Chief of Staff is also responsible for:
a) Planning, leading, and overseeing the execution of previously approved military defense strategy, that is, the operational use of the forces;
b) Ensuring that the recruitment strategy, training and promotions within the forces are conducted in accordance to the law;
c) Assessing the readiness, availability, efficiency and combat sustainability of the forces, as well as planning corrective measures, if they become necessary;
d) Ensuring the operational integration of the command, control and communications system and coordinating its territorial range.
e) Managing the units placed under his organizational structure, in other words, managing the military and civilian personnel staffing those units, without detriment of the authority of the unit chiefs.
8. The Joint Chief of Staff of the Armed Forces is replaced, in case of his absence or impediment, by the Deputy Joint Chief of Staff of the Armed Forces.
Article 16Deputy Joint Chief of Staff of the Falintil - ETDF
1. The Deputy Chief of Staff of the Armed Forces is the immediate assistant to the Joint Chief of Staff of the Armed Forces in everything regarding the Falintil – ETDF Joint Staff duties.
2. The Deputy Joint Chief of Staff of the Armed Forces is appointed and removed by the President, upon being nominated by the Government and recommended by the Joint Chief of Staff of the Armed Forces.
Article 17Headquarters
1. Headquarters is the planning and support component to the Joint Chief of Staff and it is made up of:
f) The Staff Divisions, and
g) General Support Divisions.
2. In times of war it can be structured to exert total command.
CHAPTER IIICIVILIAN AUTHORITY SUPPORT MISSION
Article 18Crisis Situation
1. A “crisis situation” shall be declared by the Government, together with the President, when there are serious or widespread disruptions of public order, which may cause imminent institutional instability but do not justify immediately declaring a state of siege or a state of emergency, to avoid suspending the rights of citizens and at the same time quickly restoring the peace that was threatened.
2. During such a crisis, the Falintil - ETDF shall assist the ETNP and other civil authorities under the terms defined in the declaration of crisis.
Article 19Catastrophes or Public Disaster Situation
1. The catastrophe or public disaster situation shall be declared when, due to an act of man or nature, namely fire, flooding, or earthquake, there is a need to adopt exceptional measures to provide immediate support to the population and restore normalcy to the living conditions in the areas that were hit.
2. During the catastrophe or public disaster situations, the Falintil - ETDF shall cooperate with the ETNP and other civilian authorities, under the terms defined in the declaration of catastrophe or public disaster.
Article 20Crisis Cabinet
1. The Crisis Cabinet is the inter-ministerial organ with authority to declare the state of crisis and catastrophe or public disaster situations, who defines the extent of intervention by the Falintil - ETDF, the mechanisms for action and force command in civilian authority support missions.
2. The Crisis Cabinet is chaired by the Prime Minister and is made up of:
a) The Vice-Prime Ministers and Ministers of State, if any;
b) The heads of the Ministry of State for Defense and for the Interior;
c) The Joint Chief of Staff of the Falintil – ETDF;
d) The General Commander of the ETNP.
3. The Prime Minister, if so understood, may call on other Ministers or members of Government to participate Cabinet meetings.
Article 21Process for Declaring a Crisis Situation
1. The crisis situation or the situation of catastrophe or public disaster shall be declared after an agreement reached between the Crisis Cabinet and the President.
2. The President shall be appraised, as early as possible, of the Crisis Cabinet meetings and invited to participate in them.
3. The Prime Minister, at all times, must keep the President informed of the matters discussed, the decisions made and the progress of the situation.
Article 22Declaring a Crisis Situation and Catastrophe or Public Disaster Situation
1. The declaration of a crisis situation or situation of catastrophe or public disaster will clearly contain the following items:
a) Characteristics and basis for the state to be declared;
b) Territorial scope;
c) Decision on the degree of intervention by military authorities and powers conferred;
d) Decision on the terms of cooperation between the Falintil - ETDF and the ETNP, if this were the case;
e) Decision on the field operations command.
Article 23Duration
The intervention by the Falintil - ETDF foreseen in this chapter cannot last more than 30 days without declaring a state of siege or state of emergency under the terms of the Constitution and specific laws.
Article 24Report on the Use of the Falintil - ETDF
Once the intervention by the Falintil - ETDF has ended and within the following 15 days, the Government shall send the National Parliament a detailed report and as much documentation as possible about the intervention.
CHAPTER IVFINAL STIPULATIONS
Article 25Identification Cards
1. Higher ranking officers, sergeants and other members of the Falintil - ETDF must bear a personal military identification card.
2. The design of the identification card shall be approved by decree by the Minister of State for Defense and published in the Official Journal.
Article 26Military Statutes and Discipline
1. The personnel statute and the military career system shall be approved by a specific by a specific Government decree.
2. The disciplinary norms applicable to the military in the exercise of their duties shall also be approved by a specific decree.
3. Until the above mentioned decrees are approved, the norms in place are those related to the statute and military career included in the UNTAET Regulations, without prejudice to the other norms of the same Regulations that are considered specifically abrogated.
Article 27Effective Date
The organic law of the Falintil - ETDF shall come into effect on the day after it is published in the Official Journal.

ANGGARAN DASAR ORGANISASI
BAB I
NAMA DAN SIFAT
Pasal 1
Organisasi ini dalam bahasa Tetum bernama Popular Monitor, dan dalam bahasa Inggris adalah People Monitor
Pasal 2
Popular Monitor bersifat organisasi non-pemerintah yang bergerak dalam bidang penelitian/investigasi, Advokasi dan kampanye.
BAB II
LAMBANG DAN ARTI
Pasal 3
Lambang Popular Monitor adalah busur anak panah dengan tulisan Popular MONITOR berbentuk perisai berwarna merah.
Pasal 4
Busur dan anak panah dan melambangkan kekuatan, ketajaman dan transparansi. Sedangkan perisai berwarna merah melambangkan komitmen dan semangat kerja keras.
BAB III
VISI DAN MISI
Pasal 5
a. Terwujudnya “Ukun Rasik An” di Negara Republik Demokratik Timor Leste yang menghormati nilai-nilai demokrasi, hak asasi manusia, keadilan, kesetaraan dan transparansi
b. Terwujudnya masyarakat Timor Leste yang bebas dari segala bentuk penindasan dan eksploitasi.
Pasal 6
a. Melakukan pemantauan terhadap kegiatan-kegiatan institusi Media cetak maupun elektronik, lembaga-lembaga swadaya masyarakat, pertahanan-keamanan dan mengkampanyekan hasil-hasilnya agar dapat mendukung keterlibatan masyarakat dalam pembuatan kebijakan sehingga mendorong terciptanya sebuah model pembangunan ekonomi yang berbasis pada kemampuan dan kebutuhan rakyat yang tidak bertolak belakang dengan kondisi alam dan budaya Timor Leste.
b. Mengembangkan model-model pembangunan alternatif dengan mempraktekkan metodologi pendidikan popular sehingga mampu merangsang proses pembelajaran bersama yang adil dan partisipatif bersama komunitas basis.
c. Melakukan advokasi dan memberikan perhatian khusus terhadap isu-isu jender, transparansi, keadilan dan agrarian reform melalui mitra kerja dengan organisasi lain.
BAB IV
KEDUDUKAN DAN KEKUASAAN TERTINGGI
Pasal 7
Popular Monitor berkedudukan di Dili ibukota Negara Republik Demokratik Timor Leste.
Pasal 8
Kekuasaan tertinggi Popular Monitor berada pada keputusan kolektif yang diselenggarakan melalui Rapat Umum Badan Pendiri.
BAB V
TUJUAN DAN KEGIATAN
Pasal 9
Memfasilitasi opini dari komunitas basis kemudian dianalisa dan dikampanyekan serta dipublikasikan melalui media organisasi Popular Monitor sendiri dan jaringan-jaringan kerja kepada Lembaga-Lembaga Internasional di Timor Leste. Sebaliknya juga akan memantau kerja-kerja Lembaga-Lembaga Internasional kemudian dianalisa dan diteruskan kepada publik dari tingkat internasional, nasional hingga tingkat komunitas basis.
Pasal 10
Kegiatan-kegiatan yang secara garis besar sebagai berikut:
a. Penelitian/Investigasi dan Penerbitan: melakukan pemantauan, penelitian dan menganalisa kegiatan-kegiatan Media cetak maupun eloktronik, institusi-institusi lembaga swadaya masyarakat dan pertahanan keamanan. Hasil penelitian ini akan dikembangkan melalui jurnal, buletin, buku, panflet dan program radio.
b. Advokasi: mengadvokasi kebijakan-kebijakan publik maupun Lembaga-Lembaga Internasional dengan mengupayakan prinsip-prinsip demokratisasi, keadilan, kesetaraan dan transparansi bagi masyarakat luas.
c. Kampanye: mengupayakan media popular dan pengembangan metode pendidikan popular serta ide-ide alternatif melalui: diskusi-diskusi basis, pertemuan publik dan lain-lain. Pengembangan Metode pelaksanaan pendidikan popular bekerjasama dengan intitusi-institusi lain.
BAB VI
STRUKTUR ORGANISASI
Pasal 11
Popular Monitor memiliki tiga organ utama, yaitu Koordinator Umum, Penasehat dan Donator dengan perannya masing-masing:
a. Koordinator Umum membawahi dua koordinator, yaitu koordinator program dan koordinator administrasi dan keuangan dengan menjalankan beberapa tugas dan fungsi.
b. Penasehat adalah anggota penasehat Popular Monitor yang terdiri dari orang Timor Leste dan tinggal di wilayah Timor Leste.
c. Donator adalah orang perorangan atau lembaga baik di dalam negeri maupun luar negeri yang memberikan dukungan keuangan untuk program dan kegiatan Popular Monitor.
BAB VII
ANGGOTA, STAF DAN HUBUNGAN-HUBUNGAN ORGANISASI
Pasal 12
Anggota Permanen adalah orang perorangan yang mendirikan Popular Monitor yang disebut dengan Badan Pendiri Popular Monitor.
Pasal 13
Staf adalah orang perorangan yang direkrut oleh Popular Monitor untuk mengabdi kepada Popular Monitor.
Pasal 14
Popular Monitor membuka diri kepada setiap pribadi yang memiliki prinsip perjuangan yang sama, organisasi-organisasi yang sifatnya komunikatif, kerjasama atau dan/atau koordinatif antar mitra kerja.
BAB VIII
HAK DAN KEWAJIBAN
Pasal 15
Anggota Badan Pendiri berhak untuk memilih dan dipilih sebagai Koordinator Umum, dan berhak untuk mengajukan usul dan pendapat dalam Rapat Umum Badan Pendiri.
Pasal 16
Setiap staf berkewajiban menjalankan setiap program dan kegiatan untuk mencapai misi dan visi Popular Monitor.
BAB IX
KEUANGAN DAN AUDIT
Pasal 17
Sumber keuangan Popular Monitor diperoleh dari sumbangan anggota dan dari sumber lain yang sah dan tidak mengikat, baik dari perorangan maupun lembaga.
Pasal 18
Pengunaan keuangan organisasi sekurang-kurangnya setiap tahun diaudit oleh auditor independen, kredibel dan profesional serta Popular Monitor menggunakan Auditor yang sama dengan jangka waktu maksimal dua tahun untuk melakukan audit terhadap keuangan organisasi.
BAB X
PENASEHAT, PEMILIHAN DAN TANGGUNGJAWAB
Pasal 19
Penasehat Popular Monitor beranggotakan orang-orang yang memiliki visi yang sama dengan visi organisasi.
Pasal 20
Pemilihan anggota penasehat Popular Monitor ditetapkan dalam Rapat Umum Badan Pendiri.
Pasal 21
Tata cara pemilihan anggota penasehat diatur dalam Rapat Umum Badan Pendiri Popular Monitor.
Pasal 22
Fungsi penasehat adalah untuk menjaga lancarnya arus komunikasi di dalam seluruh tubuh Popular Monitor, memberikan nasehat dan pendapat apabila diperlukan.
BAB XI
PENDIRIAN DAN PEMBUBARAN
Pasal 23
Popular Monitor didirikan oleh empat orang aktivis Timor Leste dengan komitmen dalam melakukan kegiatan dan program yang dapat memberi kontribusi pada pembangunan fisik maupun sosial dan psikologis di Timor Leste.
Pasal 24
Popular Monitor hanya bisa dibubarkan oleh Badan Pendiri Popular Monitor dan minimal 51% dihadiri oleh Anggota Badan Pendiri. Jika Popular Monitor dibubarkan maka segala asset dihibahkan kepada organisasi yang memiliki visi dan misi yang sama atau kepada organisasi social.
BAB XII
PENUTUP
Pasal 25
Hal-hal yang belum diatur dalam Anggaran Dasar ini akan diatur dalam Anggaran Rumah Tangga.
Pasal 26
a. Perubahan atas Anggaran Dasar ini hanya dimungkinkan melalui Rapat Umum Badan pendiri.
b. Perubahan hanya dipandang sah apabila peserta Rapat Umum Badan Pendiri memberikan persetujuannya dan minimum 51% Anggota Badan Pendiri harus hadir.

ANGGARAN RUMAH TANGGA
BAB I
NAMA DAN SIFAT
Pasal 1
a. Organisasi ini bernama Popular Monitor atau People monitor
b. Popular Monitor bersifat organisasi non-pemerintah yang anggotanya adalah Badan Pendiri Popular Monitor.
Popular Monitor bersifat organisasi non-pemerintah yang bergerak dalam bidang penelitian/investigasi, Advokasi dan kampanye.
BAB II
STRUKTUR ORGANISASI
Pasal 2
Tugas dan Fungsi Koordinator
a. Koordinator umum bertugas memimpin koordinator-koordinator bidang dan mengkoordinasikan semua program kerja dan kegiatan bersama dengan koordinator program dan administrasi keuangan, mengusahakan pendanaan organisasi, mengkoordinasikan rencana strategi organisasi bersama staf, berhubungan dengan pendonor, mengkoordinasi laporan enam bulan dan tahunan, berhubungan dengan jaringan organisasi-organisasi non-pemerinntah baik di tingkat nasional maupun internasional dan kegiatan lain-lain yang dianggap perlu demi kemajuan organisasi.
b. Koordinator program bertugas mengawasi dan membawahi program penelitian/investigasi, advokasi dan kampanye, mengkoordinasi dan mengawasi secara langsung program kerja organisasi, berhubungan langsung dengan jaringan kerja, mengharmonisasikan program sesuai misi dan visi organisasi, dan/atau melakukan usaha-usaha demi tercapainya misi dan visi organisasi.
c. Koordinator administrasi dan keuangan membawahi petugas kesekretariatan dan keuangan, mengkoordinasikan dan mengamankan semua dokumen-dokumen penting sesuai dengan prosedur pengarsipan yang ditetapkan organisasi, mengawasi kegiatan-kegiatan di dalam perkantoran, mengatur belanja organisasi, membuat laporan keuangan bulanan, tiga bulan, enam bulan dan tahunan, mengatur kuintansi pembelanjaan sesuai dengan prosedur keuangan, merencanakan belanja untuk program dan kegiatan, menghubungi auditor untuk mengaudit penggunaan keuangan organisasi, dan lain-lainnya sesuai dengan kebijakan keuangan organisasi.
Pasal 3
Tugas dan Fungsi Penasehat
Penasehat Popular Monitor bertugas memberikan pandangan, masukan dan keahlian terhadap bidang program dan kegiatan yang dilakukan oleh Popular Monitor, berpatisipasi dalam perencanaan pembuatan rencana strategi organisasi, membantu memberikan saran-saran konstruktif demi keberlanjutan organisasi sesuai dengan visi dan misi organisasi.
Pasal 4
Tugas Dan Fungsi Donator
Donatur ikut mendorong sustainability organisasi melalui bantuan keuangan, material dan moril sehingga terlaksananya program dan kegiatan Popular Monitor termasuk ikut memberikan ide-ide sesuai dengan visi dan misi organisasi.
BAB III
RAPAT UMUM BADAN PENDIRI
Pasal 5
Tempat Rapat Umum Badan Pendiri dilaksanakan di Timor Leste yang ditentukan oleh anggota Badan Pendiri Popular Monitor.
Pasal 6
Pimpinan dan Peserta Rapat Umum Badan Pendiri
a. Rapat Umum Badan Pendiri dipimpin oleh seorang Koordinator, seorang Sekretaris, dan Pemandu Program dan Kegiatan yang ditetapkan melalui kesepakatan Peserta Badan Pendiri.
b. Semua Anggota Badan Pendiri sebelum tanggal Rapat Umum Badan Pendiri adalah Peserta Rapat Umum Anggota Aktif yang berhak mengajukan pendapat, dipilih dan memilih.
c. Staf pada saat Rapat Umum Anggota Pendiri adalah peserta peninjau dan tidak berhak memilih dan dipilih.
Pasal 7
Rapat Umum Badan Pendiri dan Pengambilan Keputusan
a. Rapat Umum Badan Pendiri dianggap memenuhi forum apabila anggota Badan Pendiri yang hadir memenuhi prosentasi 51%.
b. Keputusan ditetapkan melalui musyawarah bersama dan mufakat (kolektifitas).
Pasal 8
Rapat Umum Badan Pendiri Luar Biasa
a. Berdasarkan usulan anggota Badan Pendiri, dapat dilaksanakan Rapat Umum Badan Pendiri Luar Biasa.
b. Informasi tentang pelaksanaan Rapat Umum Badan Pendiri Luar Biasa harus disampaikan dengan surat undangan resmi kepada seluruh anggota Badan Pendiri paling lambat sebulan sebelum acara Rapat Umum Badan Pendiri Luar Biasa diadakan.
Rapat Umum Badan Pendiri Luar Biasa tidak dapat membubarkan Popular Monitor, mengubah Anggaran Dasar, atau mengubah Anggaran Rumah Tangga.
BAB IV
ANGGOTA DAN STAF
Pasal 9
Persyaratan Anggota dan Staf
a. Anggota adalah orang perorangan yang merupakan anggota Badan Pendiri Popular Monitor serta orang perorangan dari Badan Pendiri yang melaksanakan program dan kegiatan sehari-hari Popular Monitor yang bersedia bekerja sesuai dengan Anggaran Dasar, Anggaran Rumah Anggota, aturan-aturan dan kesepakatan-kesepakatan organisasi.
b. Staf adalah orang perorangan yang direkrut dan dipekerjakan oleh Popular Monitor dengan masa waktu tertentu sesuai mekanisme organisasi dan bersedia untuk mentaati prinsip-prinsip dasar yang tertulis di dalam Anggaran Dasar, Anggaran Rumah Tangga serta aturan-aturan dan kesepakatan-kespakatan organisasi.
Pasal 10
Hak dan Kewajiban Anggota dan Staf
a. Setiap Anggota berhak mengetahui perkembangan organisasi, melibatkannya dalam setiap perubahan kebijakan organisasi, berpendapat dan menjalankan program dan kegiatan organisasi.
b. Setiap Anggota berhak mengajukan cuti (berhenti) sementara ataupun melepaskan status keanggotaannya.
c. Setiap staf berhak mengajukan cuti (berhenti) sementara ataupun melepaskan status kerjanya.
d. Setiap staf di lingkungan Popular Monitor diwajibkan untuk menyampaikan laporan kerjanya setiap bulan, tiga bulan, enam bulan dan satu tahun dan berhak menggunakan fasilitas Kantor Pusat Popular Monitor.
e. Setiap Anggota dan staf wajib mentaati Anggaran Dasar, Anggaran Rumah Tangga, aturan-aturan dan kesepakatan-kesepakatan organisasi.
Pelanggaran atas Anggaran Dasar, Anggaran Rumah Tangga, aturan-aturan ataupun kesepakatan-kesepakatan di lingkungan Popular Monitor akan mendapat sanksi berupa teguran, pemberhentian sementara atau pemecatan terhadap status kerjanya.
BAB V
KEUANGAN
Pasal 11
a. Keuangan dikelola langsung oleh Koordinator Administrasi dan Keuangan Popular Monitor dan dalam pengelolaannya sesuai dengan kebijakan keuangan yang telah ditetapkan oleh organisasi.
b. Pedoman tentang kebijakan keuangan Popular Monitor ditetapkan oleh anggota Badan Pendiri Popular Monitor.
c. Iuran anggota Popular Monitor adalah cadangan deposit yang akan digunakan pada situasi dimana organisasi mengalami defisit keuangan.
d. Pedoman tentang iuran ditetapkan oleh anggota Badan Pendiri Popular Monitor.
BAB VI
PENASEHAT
Pasal 12
Pembentukan dan Masa Kerja Penasehat
a. Penasehat terdiri dari orang perorangan yang memiliki kredibilitas, memiliki misi, visi yang sama dengan Popular Monitor dan ditetapkan dalam Rapat Umum Anggota Badan Pendiri.
b. Jumlah penasehat beserta komposisinya ditentukan oleh Badan Pendiri dengan memperhatikan perkembangan dan kebutuhan Popular Monitor.
c. Penasehat mempunyai masa kerja selama satu tahun dan anggotanya dapat dipilih kembali untuk masa kerja selanjutnya.
Pasal 13
Kedudukan, Fungsi dan Peran Penasehat
a. Penasehat Popular Monitor ini merupakan kelompok khusus yang mengurusi masalah-masalah signifikan di dalam organisasi seperti mengharmonisasikan ide, prinsip dasar organisasi melalui pertemuan antara anggota Badan Pendiri Popular Monitor.
b. Penasehat berfungsi sebagai wadah komunikasi, konsultasi, dan koordinasi antar anggota Badan Pendiri Popular Monitor.
c. Penasehat berperan menjaga kelancaran arus komunikasi di lingkungan Popular monitor.
d. Penasehat berperan membantu sebagai alat organisasi yang diperlukan untuk memecahkan berbagai masalah atau untuk mengemban misi tertentu, dalam jangkauan global, atau pada lokalitas tertentu, termasuk di Timor Leste.
Pasal 14
Hak dan Kewajiban Penasehat
a. Penasehat berhak mengusulkan dilaksanakannya Rapat Umum Anggota Luar Biasa.
b. Penasehat berkewajiban untuk menfasilitasi Rapat Umum Anggota Luar Biasa.
c. Penasehat berkewajiban melaksanakan amanah garis besar program yang dirumuskan dalam Rapat Umum Badan Pendiri.
d. Penasehat berhak mengikuti perencanaan strategi organisasi, memonitoring perkembangan, dan mengevaluasi implentasi program kerja Popular Monitor.
e. Penasehat berkewajiban mengusulkan Tim Pemandu Rapat Umum Anggota sebelum menyatakan diri demisioner.
Pasal 15
Pertanggungjawaban Penasehat
a. Penasehat wajib menyampaikan laporan pertanggungjawaban setiap tahun kepada Rapat Umum Badan Pendiri.
Dalam pertanggungjawaban itu dilaporkan berbagai perkembangan organisasi, usaha, kendala, dan hasil pelaksanaan amanah garis besar program yang dirumuskan oleh Rapat Umum Badan Pendiri tahun sebelumnya.
BAB VII
HUBUNGAN KE DALAM DAN KE LUAR ORGANISASI
Pasal 16
a. Hubungan antara Popular Monitor dengan Mitra kerja berbentuk horisontal, bersifat komunikatif dan dapat pula koordinatif melalui Anggota Badan Pendiri.
b. Hubungan antara penasehat dengan mitra kerja bersifat informatif dan komunikatif.
c. Hubungan antara Popular Monitor dengan organisasi atau intitusi lain yang bergerak dalam bidang tertentu bersifat informatif, komunikatif dan koordinatif.
